Without the prior consent of the patent owner, it is not permitted to manufacture, offer, sell, market, or use products or technologies that are subject to patent protection. It is likewise not permitted to import, store, or otherwise handle such products. The use or offering for use of any technical solution protected by a patent is also prohibited. Violation of patent rights includes offering, marketing, using, importing, or storing products obtained through a process protected by a patent. The owner of a registered trademark has the exclusive right to use the trademark in connection with the goods and services for which it is protected and is entitled to mark it with the ® symbol.
In cases where there is a suspicion of infringement of intellectual property rights, the authorized person has the right to request information about the origin and distribution networks of products or services that infringe those rights. This right includes, in particular, access to information about persons who manufactured, processed, stored, distributed, or supplied such goods or services, as well as information about the quantities produced or sold and the prices at which the goods or services were offered. If this information is not provided voluntarily, the authorized person may seek disclosure through legal proceedings.
If intellectual property rights are infringed, the authorized person has the right to seek remedies and compensation for damages. The rights holder may request that the infringer cease the unlawful conduct, remove the consequences of the infringement, withdraw or destroy products infringing the rights, and permanently remove or destroy tools, materials, or equipment used in connection with the infringement. The rights holder is also entitled to compensation for damages, restitution of unjust enrichment, and appropriate satisfaction, including financial compensation for non-material harm. In certain cases, the court may grant the rights holder the right to publish the decision on the infringement at the expense of the infringer. The amount of compensation may take into account the lost profit, the infringer’s unlawful gain, or the standard amount of a license fee that would have been due if the use had been authorized.
All rights to patents, trademarks, and other forms of intellectual property are reserved by their respective owners. Any unauthorized use of these rights may be considered an infringement of intellectual property and may result in civil, commercial, or criminal liability.
